What happened
The Landlord applied to evict the Tenants for non-payment of rent. The Tenants were properly served but did not attend the hearing. The Landlord provided evidence that a valid N4 notice was served, which the Tenants did not void. The Landlord also attempted to negotiate a repayment agreement with the Tenants, who were unresponsive. As of the hearing date, the Tenants were still in possession of the rental unit and had not made any payments since the application was filed.
The ruling
The tenancy is ordered terminated unless the Tenants void the order by paying $15,586.00 by February 9, 2025. If the order is not voided, the Tenants must vacate by February 9, 2025, and pay the Landlord $12,704.93 plus daily compensation of $72.33 from January 22, 2025. Failure to pay will result in interest accruing at 5.00% annually.
