What happened
The named Tenant requested a review of two prior orders, asserting she was a victim of identity theft. An imposter had used the Tenant's identity to enter into the tenancy agreement, engage in LTB proceedings, and accrue debt. During the hearing, the Landlord acknowledged the fraud and consented to withdraw their original application and cancel the previous orders. The imposter had pleaded guilty to fraud charges related to the impersonation.
The ruling
By consent of both parties, the Tenant's request for review is granted. Two previous orders (EAL-99072-21 and EAL-99072-21-RV) are cancelled and replaced by this order. The Landlord's L4 application is withdrawn, and the Board's file is closed. This decision rectifies the situation where the named Tenant was wrongly implicated due to identity theft by an imposter.
