What happened

The Landlord originally applied for an order to terminate the tenancy and evict the Tenants because they allegedly failed to meet a condition in a previous LTB order dated January 8, 2025. An ex parte order (without a hearing) was issued on January 31, 2025. The Tenants subsequently filed a motion to set aside that order.

The ruling

By consent of both parties, the motion to set aside the order dated January 31, 2025, is granted. That order is set aside and cannot be enforced. However, the original order LTB-L-064386-24 dated January 8, 2025, remains unchanged and active.
