What happened
The Landlord applied to terminate the tenancy and evict the Tenant for non-payment of rent. An interim order from a previously adjourned hearing required the Tenant to pay ongoing rent and disclose any issues under s.82, which the Tenant failed to do. Consequently, the Board declined to hear the Tenant's issues. The Tenant had already vacated the rental unit on January 22, 2025. The Board ordered the Tenant to pay the outstanding rent arrears and application fee, denying the Tenant's request for a 37-month payment plan.
The ruling
The tenancy is terminated effective January 22, 2025, the date the Tenant vacated. The Tenant is ordered to pay the Landlord $9,434.56 for rent arrears and the application fee. The Tenant's request for a lengthy payment plan was denied as unreasonable and prejudicial to the Landlord.
