What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to significant rent arrears exceeding $30,000. An interim order had previously been issued requiring the Tenant to pay rent on time and disclose evidence for potential Section 82 maintenance/tenant rights issues. While the Tenant made some late payments, she failed to comply with the disclosure requirements, leading the Member to bar her from raising Section 82 issues at the final hearing. The Tenant's proposed 86-month repayment plan was rejected as unreasonable.
The ruling
The tenancy is terminated effective June 20, 2025. The Tenant is ordered to pay $30,014.92 to the Landlord for rent arrears and the application fee. The Tenant may void the eviction by paying a total of $32,336.00 by June 20, 2025, which includes rent for the period up to the termination date. If the Tenant does not vacate or void the order, the Landlord may enforce the eviction starting June 21, 2025.
