What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The tenancy is terminated unless the tenant pays $12,899.24 by April 30, 2023 or $14,195.86 by May 8, 2023 to void the order. If the tenant does not void the order, they must pay $11,132.95 to the landlord and vacate the unit by May 8, 2023. The landlord is entitled to daily compensation of $42.63 for the tenant's continued occupation after April 20, 2023.
