What happened

A Tenant requested a review of a previous review order. The Tenant had initially requested a review of a denied motion to set aside an eviction order, which resulted in a consent order. The Tenant then sought to review this consent order, claiming he was medically unfit to participate in the hearing. The LTB denied the second review request, citing Rule 26.18 which prohibits a party from reviewing a review order they initiated. The adjudicator found no grounds to waive the rule, noting the Tenant had fully participated in the prior hearing and freely entered into the consent agreement.

The ruling

The Tenant's request to review the review order from May 12, 2025, is denied. The original order is confirmed and remains unchanged. The denial is based on LTB Rule 26.18, which prevents a party from filing a second review request for the same matter.
