What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant requested an adjournment to prepare and file additional evidence to support maintenance claims under Section 82 of the Residential Tenancies Act, 2006, but the request was denied as the Tenant failed to comply with the Board's rules for providing notice and disclosure. The parties then consented to terms to resolve the application.

The ruling

The Tenant shall pay the Landlord $1,533.85 for rent arrears and application costs, in two installments by October 15, 2024. The Tenant shall also pay new rent on time and in full until the arrears are paid. If the Tenant fails to make any of the payments, the Landlord may apply to the LTB for an order terminating the tenancy and evicting the Tenant.
