What happened
The Landlord applied to evict the Tenant for non-payment of rent that accrued after the Tenant declared bankruptcy. A previous LTB order for arrears up to the bankruptcy date had been stayed. The Tenant failed to make any payments for the post-bankruptcy period and also failed to provide written submissions regarding relief from eviction as instructed during the hearing.
The ruling
The tenancy is conditionally terminated. The Tenant can void the eviction by paying $29,296.00 by March 31, 2025, or $31,756.00 by April 4, 2025. If the Tenant does not pay and the tenancy is terminated, they must pay the Landlord $22,282.74 for arrears and costs, plus daily compensation for any overholding period. Relief from eviction was denied because the Tenant failed to provide written submissions on the issue as instructed by the Board.
