What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Tenant failed to meet a condition specified in the order on consent issued by the LTB on September 28, 2022. The Tenant filed a motion to set aside the ex parte order issued on March 2, 2023.

The ruling

The Tenant's motion to set aside the ex parte order is granted. The previous LTB Order issued on September 28, 2022 is cancelled and replaced. The Tenant shall pay $2,300 to the Landlord in arrears according to a structured repayment schedule. If the Tenant fails to make any of the scheduled payments, the Landlord may apply to the LTB for an order terminating the tenancy and evicting the Tenant.
