What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. One of the tenants, Robyn Lelay, attended the hearing and informed the Landlord that she had vacated the unit the previous week.

The ruling

The tenancy is terminated unless the Tenant pays $23,186 to void the order by May 29, 2023. If the Tenant does not pay, they must move out by May 29, 2023 and pay the Landlord $18,112.54 plus daily compensation of $75.62 per day starting April 26, 2023 until the Tenant moves out.
