What happened
The Landlord applied to terminate the tenancy and evict the Tenants due to significant rent arrears. Tenant 2 attended the hearing and explained that the arrears accumulated while he was out of the country caring for his ill mother. He proposed a payment plan involving large lump sums ($5,000 immediately and $5,000 in September), which the Adjudicator found unrealistic given the household's monthly income of $4,500 and existing monthly deficit. The Landlord sought a quick termination, but the Adjudicator granted a postponement until the end of September 2025 due to the Tenants' five-year residency.
The ruling
The tenancy is terminated effective September 30, 2025. The Tenants are ordered to pay $12,962.71 to the Landlord for rent arrears and the filing fee, after deducting the rent deposit and interest. If the Tenants pay $17,545.48 by September 30, 2025, the eviction order will be voided and the tenancy will continue. Daily compensation of $75.37 applies for each day the Tenants remain in the unit after August 27, 2025.
