What happened
The Landlord applied to terminate the tenancy because he requires the rental unit for his own residential occupation and that of his family. The Landlord's wife recently gave birth and requires support from her parents who live in St. Catharines. The Tenants disputed the application, alleging that the N12 notice was served in bad faith following a disagreement over a renovation project Tenant 1 was performing for the Landlord at a different property. The Tenants also requested relief from eviction citing Tenant 2's ongoing cancer treatment and the children's schooling needs.
The ruling
The LTB ordered the termination of the tenancy effective September 7, 2025. The Landlord proved a good faith intention to occupy the unit for residential purposes. The Tenants are ordered to pay $2,275.46 to the Landlord, representing compensation for use of the unit for October and November 2024, minus the rent deposit and interest. The Tenants are also liable for $77.26 per day from December 11, 2024, until they vacate.
