What happened

The Landlord applied for termination of tenancy and eviction due to substantial rent arrears totaling $24,000.00. The Tenants admitted to the arrears but claimed they withheld rent to perform their own repairs. The Tenants' request to raise maintenance issues under section 82 was denied because they failed to provide proper disclosure to the Landlord as required by LTB Rule 19.

The ruling

The tenancy is terminated effective December 14, 2025, unless the Tenants void the order by paying the full arrears plus filing fees. If the Tenants fail to void the order, they must move out by the termination date and pay the Landlord $14,697.14 (representing arrears minus the deposit and interest) plus daily compensation of $263.01 until they vacate.
