What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant had not vacated the rental unit by the hearing date.

The ruling

Unless the Tenant voids the order by paying $16,486 by February 28, 2025 or $17,386 by March 1, 2025, the tenancy will be terminated. If the Tenant does not void the order, they must pay $14,706.60 to the Landlord, which includes rent arrears up to the hearing date and the application filing fee, minus the rent deposit and interest on the deposit. The Tenant must also pay daily compensation of $29.59 for each day of occupation starting February 5, 2025 until they vacate the unit.
