What happened
The Landlord applied for termination of the tenancy and compensation for extensive property damage. The rental unit, which had been recently renovated, was found to have bio-hazard contamination, including animal feces, urine stains, garbage, and a flea infestation. One tenant had moved out months prior but was found to be jointly liable for the damages as the tenancy was not legally severed. The cost of repairs exceeded the Board's monetary jurisdiction.
The ruling
The tenancy is terminated effective July 15, 2025. The Tenants are ordered to pay the Landlord $35,186.00, representing the maximum jurisdictional amount for property damage and the application filing fee. This award accounts for the cost of professional bio-hazard cleaning, flooring replacement, and remediation of animal-related damages.
