What happened

The Landlord applied for termination of tenancy and eviction based on non-payment of rent and persistent late payment. The Tenants were late with rent payments 10 times in the last 12 months. Despite receiving $3,200.00 since the application was filed, arrears remained. The Tenants did not attend the hearing.

The ruling

The tenancy is terminated effective August 26, 2025, unless the Tenants pay $3,070.85 by that date to void the eviction. If they do not void the order, they must vacate and pay $642.61 plus daily compensation. If they do void the non-payment portion, they must pay rent on time every month from September 2025 to August 2026 or face eviction without notice via a section 78 application.
