What happened

Landlords applied to terminate the tenancy and evict Tenants due to persistent late payment of rent since August 2021. The application was ultimately dismissed because the N8 notice served by the Landlords was found to be legally insufficient. It failed to provide specific dates and times of the alleged late payments, which is a requirement under the Residential Tenancies Act to allow a tenant to know the case they must meet.

The ruling

The Landlords' application to terminate the tenancy for persistent late payment of rent was dismissed. The LTB Member ruled that the N8 notice provided to the Tenants was invalid because it was too vague, failing to specify the exact dates and details of the late payments as required by Section 43(2) of the Residential Tenancies Act.
