What happened
The Tenants filed an application (T1) alleging the Landlord collected or retained money illegally due to rent increases implemented without proper notice and above the provincial guideline. The Landlord increased the rent twice during the tenancy. The first increase was deemed lawful because it was paid for 12 consecutive months. The second increase was found illegal as it lacked proper notice and exceeded the guideline.
The ruling
The Landlord is ordered to pay the Tenants $596.00. This consists of $548.00 for illegal rent collected (after accounting for unpaid rent and excess N12 compensation) and the $48.00 application filing fee. The lawful rent was determined to be $3,200.00, rendering the increase to $3,400.00 void.
