What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The Tenants are ordered to pay $26,111.85 to the Landlord, which includes rent arrears up to November 30, 2023 and the cost of filing the application. The Tenants shall pay $2,176.00 per month towards the arrears from December 1, 2023 to October 1, 2024, and $2,175.85 on November 1, 2024. The Tenants shall also pay the new rent on time and in full as it comes due. If the Tenants fail to make any of the payments, the Landlord may apply to the LTB to terminate the tenancy and evict the Tenants.
