What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant was served with an N4 notice but failed to pay the arrears or attend the hearing. The Landlord presented evidence of significant arrears and prior attempts to establish a repayment plan which the Tenant ignored.

The ruling

The tenancy is terminated unless the Tenant pays $7,303.60 by August 31, 2025, or $8,635.26 by September 5, 2025, to void the order. If the Tenant does not pay, they must vacate by September 5, 2025. In the event of termination, the Tenant is ordered to pay the Landlord $5,245.00, plus daily compensation of $43.78 from August 14, 2025, until they move out.
