What happened
The Landlord applied to terminate the tenancy following the Tenants' breach of a mediated settlement. The Tenants filed a motion to set aside the resulting ex parte eviction order. The LTB heard the motion and determined that the Tenants had failed to pay rent and arrears as agreed, choosing instead to send $5,000.00 to a family member overseas. The adjudicator found the Tenants' income insufficient to sustain the tenancy and arrears payments, leading to a denial of the motion.
The ruling
The Tenants' motion to set aside the eviction order was denied. The LTB found that the Tenants breached a mediated settlement by failing to pay arrears and ongoing rent. The stay of the eviction order LTB-L-075664-25 is lifted effective November 5, 2025, allowing the Landlord to proceed with eviction due to $14,400.00 in arrears.
