What happened
The Landlord applied to terminate the tenancy and evict the Tenants for non-payment of rent. While the Tenants did not attend the hearing, evidence showed they had been paying rent regularly since the application was filed and had successfully reduced their arrears. The Landlord expressed willingness to allow a slight delay in eviction to give the Tenants time to settle the remaining balance.
The ruling
The tenancy is terminated effective September 30, 2025. The Tenants may void this order by paying $2,615.46 by the termination date. If the Tenants do not void the order, they are ordered to move out and pay the Landlord $385.63, representing the remaining arrears and filing fee after applying the rent deposit and interest. Daily compensation of $36.51 applies from August 28, 2025, until the unit is vacated.
