What happened

The Tenant filed a T1 application seeking a rebate of $21.25, claiming the Landlord illegally retained interest on the rent deposit. The Tenant also alleged the Landlord failed to provide rent receipts and shared his personal email with property management software without consent. The Landlord maintained that the law allows the interest to be applied to 'top up' the rent deposit.

The ruling

The Tenant's application for a rebate of money was dismissed. The Board found that the Landlord acted within their legal rights under Section 106(7) of the Residential Tenancies Act by applying the rent deposit interest to the deposit top-up rather than paying it directly to the Tenant.
