What happened
The Landlords applied to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant attempted to raise maintenance issues regarding air conditioning and challenged the legality of a past rent increase. However, the Board found the rent increase valid as it had been paid for over 12 months and dismissed the maintenance claims due to a lack of timely disclosure and evidence. The Board granted the eviction but delayed it to allow the Tenant time to find new housing.
The ruling
The LTB ordered the termination of the tenancy due to non-payment of rent. The Tenant owes $5,131.15 as of the hearing date (after deducting the deposit and interest). The Tenant was denied the ability to raise maintenance issues due to procedural failures. However, the Tenant was granted a delay in eviction until January 31, 2026, to secure new housing. The Tenant may void the eviction by paying the total arrears and filing fees by the specified dates.
