What happened
The Landlord requested a review of an order that had dismissed their application for termination of tenancy and rent arrears. The dismissal occurred because the Landlord's representative failed to appear at the original hearing due to a scheduling error involving multiple files across different hearing rooms. The Member found that the Landlord intended to attend and was unable to participate due to a clerical mistake. The underlying dispute involved substantial rent arrears for a high-end unit.
The ruling
The LTB cancelled the previous dismissal order and granted the Landlord's application. The tenancy was declared terminated effective June 29, 2025, the date the Tenant vacated the unit. The Tenant is ordered to pay $8,006.28 to the Landlord, representing arrears and the filing fee minus the security deposit and accrued interest.
