What happened

Landlords applied to terminate the tenancy and evict the Tenant for persistent late payment of rent. The Landlords also sought daily compensation for the period the Tenant stayed past the termination date. However, the Tenant vacated the rental unit on November 1, 2025, which was prior to the termination date specified in the N8 notice. The Board found the N8 notice to be legally invalid as it lacked necessary particulars.

The ruling

The application for eviction based on persistent late payment was dismissed because the N8 notice was technically deficient; it failed to state the dates when rent was due. Although the application was dismissed, the tenancy was officially terminated as of November 1, 2025, because the Tenant had already moved out. No compensation was awarded to the Landlords.
