What happened

The Tenant applied for an order determining that the Landlord failed to meet maintenance obligations following a water leak that began on May 19, 2024. The Tenant claimed the unit was uninhabitable and requested damages for belongings and a rent abatement. The Landlord argued they responded reasonably and attempted to withhold a portion of the last month's rent deposit as a penalty for the Tenant terminating the tenancy early after the parties mutually agreed to end the lease on June 15, 2024.

The ruling

The Landlord is ordered to pay the Tenant $1,039.94 by September 16, 2025. This amount includes a $116.69 rent abatement for a delayed maintenance response, the return of $875.25 in illegally withheld rent deposit funds, and the $48.00 application filing fee. The Board found that while the Landlord repaired the leak reasonably once they started, they could not charge a penalty for the Tenant moving out on a date the Landlord themselves suggested.
