What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants for non-payment of rent. At the hearing, the arrears were not in dispute. One of the Tenants testified about securing new employment and requested a conditional order to repay the arrears over time to preserve the tenancy. The Landlord sought termination due to the high amount of arrears.
The ruling
The Tenants are ordered to pay the Landlord $10,772.48 for rent arrears and costs, based on a specific 9-month payment plan. The Tenants must also pay their regular monthly rent on time. If they fail to make any payment as ordered, the Landlord can apply for an immediate eviction order without notice. The tenancy is not terminated, as relief from eviction was granted.
