What happened
The Landlord applied to terminate the tenancy because he requires the rental unit for his own residential occupation. The Landlord has been living with his brother for over a year and wishes to move back into his own home. Despite providing notice of vacating, the Tenants have not returned the keys and continue to use the laundry facilities, leading the Landlord to seek a formal eviction order.
The ruling
The tenancy is terminated effective October 19, 2025. The Tenants are ordered to pay the Landlord $6,881.42 for use and occupation of the unit from July 1, 2025, to September 29, 2025, plus daily compensation of $75.62 until they vacate. An eviction order was granted as the unit was not considered abandoned despite the Tenants moving most possessions, as they kept the keys and continued using facilities.
