What happened
Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
The ruling
The tenancy will be terminated on January 2, 2024 unless the Tenant pays $39,336 by December 31, 2023 or $40,686 by January 2, 2024 to void the order and continue the tenancy. If the Tenant does not void the order, they must pay $31,502.28 in rent arrears and filing costs, plus daily compensation of $44.38 starting July 7, 2023 until they vacate the unit.
