What happened

The Tenants filed an application claiming the Landlord failed to meet maintenance obligations due to a cockroach infestation and cleanliness issues at the start of the tenancy. Tenant 4 testified that upon moving in on February 2, 2025, the unit was dirty and infested with dead and live cockroaches. Despite notifying the Landlord and giving her time to remedy the situation, the condition did not improve. The Tenants returned the keys on February 21, 2025, claiming they could not live in the unit. The Tenants sought a full return of rent and termination of the tenancy.

The ruling

The Landlord is ordered to pay the Tenants $2,038.40 by December 29, 2025. This amount includes a 30% rent abatement for the period between February 2 and February 21, 2025, and the application filing fee. The request to terminate the tenancy was denied as the Tenants chose to vacate rather than being forced by an untreatable breach.
