What happened
The Landlord applied to terminate the tenancy and evict the Tenants due to significant rent arrears. The Tenants contested the amount, claiming they made cash payments, but failed to provide any receipts or evidence. The LTB found the arrears to be substantial, exceeding $35,000, and ordered eviction unless the Tenants paid the full amount to void the order.
The ruling
The tenancy is terminated effective August 31, 2025. To void the eviction, the Tenants must pay $39,186.00 by July 31, 2025, or $42,186.00 by August 31, 2025. If the Tenants do not void the order and fail to move out, the Landlord can enforce the eviction through the Sheriff starting September 1, 2025. The Tenants are ordered to pay $30,232.85 for arrears up to the hearing date plus daily compensation for continued occupancy.
