What happened

The Landlord applied to terminate the tenancy because the Tenant failed to meet conditions of a previous LTB order (LTB-L-014403-25). An eviction order was issued without a hearing on June 13, 2025. The Tenant filed a motion to set aside that order, claiming maintenance issues and financial hardship. The Tenant admitted to breaching the payment plan, owing approximately $12,150 in rent arrears.

The ruling

The Tenant's motion to set aside the eviction order was denied. The stay on the original eviction order (LTB-L-046656-25) is lifted effective August 31, 2025. The Tenant remains responsible for approximately $12,150 in rent arrears. The adjudicator found that the Tenant's inability to follow a previous payment plan and the lack of a realistic future plan justified the eviction.
