What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year. The Landlord has an ongoing dispute with the next-door neighbor at his current home that has led to criminal charges, and he wishes to move away to avoid further issues.

The ruling

The tenancy is terminated effective September 2, 2023. The Tenant must vacate the unit by this date. If the unit is not vacated, the Landlord may file the order with the Court Enforcement Office for enforcement. The Tenant owes the Landlord $1,049.91 as of June 15, 2023, which includes compensation for use of the unit from May 1 to June 15, 2023, less the rent deposit and interest. The Tenant will also owe $75.62 per day from June 16, 2023 until the date they move out.
