What happened

The Tenant applied for remedies after the Landlord illegally entered the unit, harassed and threatened her, and withheld vital services including heat, hydro, and hot water. The Landlord, a mortgagee in possession, claimed ignorance of the tenancy despite prior LTB proceedings and ignored an interim order to restore services. Additionally, the Landlord's legal representative was found to be ineligible to provide legal services due to a lack of insurance.

The ruling

The Landlord is ordered to pay the Tenant $1,998.00 for rent abatement and filing fees. Additionally, the Tenant is granted an ongoing 50% rent abatement until heat, hydro, and hot water are fully restored. Due to a blatant disregard for the Act and failure to follow a previous interim order, the Landlord must pay a $10,000.00 administrative fine to the Board. The Landlord is also barred from filing further applications until the fine is paid.
