What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to the Landlord's good faith requirement of the rental unit for the purpose of residential occupation by the Landlord and their daughter. The Tenant disputed the service of the N12 notice and alleged the notice was given in bad faith.

The ruling

The Landlord's application to terminate the tenancy and evict the Tenant was granted. The Landlord established a genuine intention to occupy the unit for their own residential use. The Tenant was given until April 16, 2025 to vacate the unit. The Tenant is required to pay daily compensation of $103.32 starting December 15, 2024 until the date they move out.
