What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.
The ruling
The tenancy will be terminated on June 30, 2023 unless the tenants pay $860.40 by May 31, 2023 or $1,817.49 by June 30, 2023 to void the order. If the unit is not vacated by June 30, 2023, the landlord may file the order with the Sheriff for enforcement starting July 1, 2023. The landlord owes the tenants $876.64 for the rent deposit and interest, but can deduct $31.47 per day for compensation starting May 10, 2023 until the tenants move out.
