What happened

The Landlord initially applied to terminate the tenancy after the Tenant breached conditions of a previous LTB order. An ex-parte order for eviction was issued on May 5, 2025. The Tenant subsequently filed a motion to set aside that order. Despite the Tenant's absence at the hearing, the Landlord's representative consented to setting aside the eviction because the Tenant had paid all outstanding arrears and costs prior to the specified deadline.

The ruling

The motion to set aside the eviction order (LTB-L-034401-25) is granted. The Landlord consented to this action because the Tenant paid all rent arrears and costs owing under the previous board order before May 31, 2025. The eviction order is now unenforceable, and the previous order from April 17, 2025, is deemed exhausted.
