What happened
The Landlord applied for an order to terminate the tenancy for personal use (N12). The Landlord, who is separated from his spouse, requires the unit for himself and his children as he is currently staying with friends. The Tenant did not attend the hearing and was reportedly incarcerated for a portion of the tenancy, with significant rent arrears accumulating since late 2024. The Landlord provided the required compensation through a rent waiver agreement.
The ruling
The LTB ordered the termination of the tenancy effective November 28, 2025. The Landlord was found to have a genuine, good-faith intention to occupy the unit following a marital separation. The Tenant is required to vacate the premises by the termination date; otherwise, the Landlord may enforce the eviction through the Sheriff starting November 29, 2025.
