What happened

The Landlord originally applied for an eviction order and compensation because the Tenant failed to comply with a previous order (LTB-L-084780-24) regarding unpaid utilities. However, the Tenant vacated the unit before the hearing of that application, leading the Member to dismiss the application as moot on July 8, 2025. The Tenant requested a review of that dismissal, arguing the application should have been consolidated with other outstanding matters. The Board found no serious error in the original decision and denied the review request.

The ruling

The Tenant's request for a review of the July 8, 2025 order was denied. The Board confirmed that because the Tenant had vacated the rental unit before the hearing, the Landlord's application for eviction based on a breach of utility payment conditions was moot. The Board further clarified that the decision to not consolidate the hearing with other applications was within the Member's discretion and did not constitute a serious error.
