What happened
Six tenants filed a T1 application alleging that the Landlords collected or retained money illegally due to miscalculations of Above Guideline Rent Increases (AGI). The tenants sought a determination of lawful rent and a refund of overpayments. At the hearing, the parties reached a consent agreement regarding the correct lawful monthly rent for each unit and the total amount of overcharges to be refunded by the Landlord.
The ruling
By consent of the parties, the Landlord is ordered to pay a total of $13,763.32 to six tenants (Tenants 1 through 6) to account for rent overcharges resulting from miscalculated Above Guideline Increases. The lawful monthly rents for each unit were fixed, and payments are due to the tenants on or before September 26, 2025.
