What happened
The Landlords applied to terminate the tenancy because the Tenant had been persistently late in paying rent. Evidence showed that between January 2024 and April 2025, rent was paid late in 8 out of 16 months. The Tenant did not contest the late payments but claimed a change in financial circumstances that would allow for future timely payments.
The ruling
The tenancy continues provided the Tenant complies with specific conditions. The Tenant must pay the October 2025 rent by November 17, 2025, and must pay all monthly rent in full and on time from December 1, 2025, to November 1, 2026. The Tenant is also ordered to reimburse the Landlords $186.00 for the application filing fee. If the Tenant breaches these conditions, the Landlords may apply for an ex-parte eviction order under Section 78.
