What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant based on a breach of a previous LTB order (File LTB-L-007597-25). An initial order (LTB-L-038271-25) was issued without a hearing on May 16, 2025. The Tenant filed a motion to set aside that order, which led to a hearing where both parties consented to a new repayment plan for substantial rent arrears.

The ruling

The LTB granted the Tenant's motion to set aside a previous ex-parte eviction order. On consent of both parties, the Tenant is ordered to pay $12,486.00 in arrears and costs according to a strict schedule, beginning with $10,000.00 by July 21, 2025. If any payment is missed, the Landlord may apply for an ex-parte eviction order.
