What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant after the Tenant breached a payment condition in a previous LTB order (August 27, 2025). An ex parte eviction order was issued on October 29, 2025. The Tenant filed a motion to set aside this eviction order, arguing that he had experienced temporary job loss but was now employed and the tenancy was financially sustainable.

The ruling

The LTB granted the Tenant's motion to set aside the eviction order issued on October 29, 2025. The Adjudicator found that the Tenant's recent employment and efforts to pay down arrears made the tenancy sustainable. A new payment plan was ordered, requiring the Tenant to pay the remaining $2,406.72 in three installments by February 2026, alongside regular monthly rent. Failure to meet any payment allows the Landlord to re-apply for eviction without further notice.
