What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.
The ruling
The tenancy will be terminated on July 16, 2023 unless the tenants pay $2,173 by June 30, 2023 or $3,386 by July 16, 2023 to void the order. If the tenants do not pay, they must move out by July 16, 2023 and pay the landlord $1,159.40 in rent arrears and application fees, plus $39.88 per day in compensation for use of the unit after June 6, 2023.
