What happened
The Landlords applied to terminate the tenancy and evict the Tenant due to non-payment of rent. During the hearing, it was determined that the N4 notice served by the Landlords was invalid because it contained incorrect rent amounts and specified an incorrect rental period. Consequently, the Landlords could not obtain an eviction order but proceeded with the application to recover rent arrears, as the Tenant was believed to have vacated the unit.
The ruling
The application for eviction was denied because the Landlord's N4 notice was invalid due to administrative errors. The Tenant is ordered to pay $1,879.25 to the Landlord for rent arrears and the application filing fee. Additionally, the Tenant must pay daily compensation of $19.73 from September 26, 2025, until the date they move out. If payment is not made by October 19, 2025, interest will accrue at a rate of 4.00% annually.
