What happened

The Landlord applied for a review of a previous order that likely dismissed his application for non-payment of rent because he did not attend the hearing. The Landlord's representative testified that the Landlord has been hospitalized since April 2025 undergoing chemotherapy and was in no condition to attend or manage a representative at the time of the original hearing. The Tenant opposed the review, arguing the Landlord was negligent for not sending someone else.

The ruling

The LTB granted the Landlord's request for review of the previous order dated May 26, 2025. The Board found the Landlord was unable to attend the original hearing due to being hospitalized for chemotherapy. The original order is cancelled, and a new hearing on the merits of the non-payment of rent application will be scheduled.
