What happened

Landlords applied for termination and eviction based on non-payment of rent. A secondary application for out-of-pocket expenses due to substantial interference was also filed but withdrawn during the hearing. The primary issue involved the validity of the service of the N4 notice, specifically whether email service was consented to and whether hand-delivering notices for all tenants to a single tenant constituted valid service for all.

The ruling

The tenancy is terminated effective September 14, 2025. The Tenants are ordered to pay $9,215.87 to the Landlords for arrears and filing fees (after deducting the deposit and interest). The Tenants may void the eviction by paying $13,686.00 on or before September 14, 2025. If they do not pay or move out, the Sheriff is authorized to enforce eviction starting September 15, 2025.
