What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. At the hearing, the Tenant did not dispute the eviction but requested a delay to move out, citing financial hardship as his primary income is from ODSP. The Landlord opposed any delay, stating his own financial struggles with mortgage payments due to the lack of rental income.
The ruling
The tenancy is terminated unless the Tenant voids the order by paying the full amount owing. The Tenant can pay $5,751.00 by April 30, 2025, or $6,676.00 by May 9, 2025, to continue the tenancy. If the Tenant fails to pay, they must vacate by May 9, 2025. If the order is not voided, the Tenant is ordered to pay the Landlord $4,478.79 for arrears and fees up to the hearing date, plus daily compensation of $30.41 from March 20, 2025, until moving out. The Board denied the Tenant's request for relief from eviction.
